Terms of Service

Welcome to Datable. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Datable, Inc. ("Datable," "we," "us," or "our"), governing your access to and use of the Datable mobile application, website at datable.me, and all related services, features, and content (collectively, the "Service").

By creating an account, downloading the Datable app, accessing our website, or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not access or use the Service.

These Terms also govern your use of any third-party services integrated with Datable, including but not limited to the Oura API and Apple Health. Your use of those integrations is additionally subject to the respective third-party terms of service and privacy policies.

You must be at least 13 years of age to use the Service. If you are between 13 and 17 years of age, you may only use the Service with verifiable parental or guardian consent. By using the Service, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under applicable law
• You will use the Service only for lawful purposes and in accordance with these Terms
• All registration information you provide is accurate, current, and complete

Datable is currently available to users in the United States. We may expand availability to other regions over time. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

3.1 Account Registration

To access most features of the Service, you must create an account. You agree to provide accurate, complete, and current information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3.2 Account Security

You agree to notify us immediately at [email protected] if you suspect any unauthorized access to or use of your account. Datable will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

3.3 Account Termination by You

You may delete your account at any time through the app settings or by contacting us at [email protected]. Upon account deletion, we will delete your personal data in accordance with our Privacy Policy.

3.4 One Account Per User

Each user may maintain only one active Datable account. Creating multiple accounts to circumvent restrictions or bans is prohibited.

4.1 Description

Datable is a relationship health and longevity platform that combines biometric data with relationship intelligence. The Service includes:

• The Datable mobile application (iOS and Android)
• Jules AI — an AI-powered relationship coaching assistant
• Bio-Social Health Score™ — a proprietary metric correlating biometric and relationship data
• Loveprint™ — a relationship archetype and compatibility profile
• Wearable device integrations (Oura Ring, Apple Health)
• The Datable website and web-based tools
• Enterprise and provider dashboard features (where applicable)

4.2 Not Medical Advice

The Service is for informational and wellness purposes only. Datable is not a medical device, does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional medical care. The Bio-Social Health Score™, Jules AI responses, and all other insights provided by Datable are general wellness information and should not be relied upon as medical advice.

If you have a medical condition, mental health concern, or relationship crisis, please consult a qualified healthcare provider, licensed therapist, or other appropriate professional. In an emergency, call 911 or your local emergency services.

4.3 Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

4.4 Beta Features

Datable is currently in beta. Certain features may be experimental, incomplete, or subject to change. Beta features are provided "as is" without warranty of any kind.

5.1 Oura Ring Integration

Datable integrates with the Oura API to access biometric data from your Oura Ring. By connecting your Oura account to Datable, you:

• Expressly authorize Datable to access your Oura data through the Oura API on your behalf
• Acknowledge that your use of Oura data through Datable is subject to the Oura Terms of Service and Oura Privacy Policy
• Acknowledge that Oura may collect certain usage data related to your use of the Oura API through Datable, as described in our Privacy Policy
• Understand that Datable is an independent developer application and is not affiliated with, endorsed by, or sponsored by Oura
• Agree that Datable's disclaimers of warranties and limitations of liability (Sections 9 and 10) apply to all third-party service providers, including Oura

You may disconnect your Oura account from Datable at any time through the app settings or through your Oura account at cloud.ouraring.com. Upon disconnection, Datable will delete your Oura data in accordance with our Privacy Policy.

5.2 Apple Health Integration

Datable integrates with Apple HealthKit to access health and fitness data from your iPhone and connected devices. By enabling this integration, you grant Datable permission to read the health data types specified during the authorization flow. You may revoke this access at any time through iPhone Settings → Privacy & Security → Health → Datable.

Datable's use of Apple Health data complies with Apple's HealthKit guidelines. We do not use HealthKit data for advertising, do not share it with third parties for commercial purposes, and do not disclose it in a manner inconsistent with Apple's guidelines.

5.3 Other Third-Party Services

The Service may integrate with or link to other third-party services, websites, or platforms. Datable is not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk and subject to their respective terms.

6.1 Your Content

You retain ownership of all content you submit, post, or transmit through the Service ("User Content"), including relationship check-ins, journal entries, and responses to Jules AI. By submitting User Content, you grant Datable a limited, non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing the Service to you.

6.2 Prohibited Content

You agree not to submit User Content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Infringes any third party's intellectual property rights
• Contains viruses, malware, or other harmful code
• Impersonates any person or entity
• Violates any applicable law or regulation

6.3 AI Training

We may use de-identified, aggregated User Content to train and improve Jules AI and other machine learning models. We will never use personally identifiable User Content for AI training without your explicit consent. You may opt out of AI training data use by contacting us at [email protected].

7.1 Datable's IP

The Service and all of its content, features, and functionality — including but not limited to the Bio-Social Health Score™, Loveprint™, Jules AI, the Datable name and logo, software, text, graphics, and data — are owned by Datable, Inc. and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

These Terms do not grant you any right, title, or interest in the Service or Datable's intellectual property beyond the limited license to use the Service as described herein.

7.2 License to Use the Service

Subject to your compliance with these Terms, Datable grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. You may not sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the Service.

7.3 Feedback

If you provide Datable with feedback, suggestions, or ideas about the Service, you grant Datable a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without compensation or attribution to you.

7.4 Oura Trademarks

"Oura" and the Oura logo are trademarks of Oura Health Oy. Datable uses these marks solely to describe the integration and in compliance with Oura's Branding Guidelines. Datable is not affiliated with, endorsed by, or sponsored by Oura Health Oy.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Scrape, crawl, or use automated means to access or collect data from the Service
• Use the Service for any commercial purpose without Datable's prior written consent
• Interfere with or disrupt the integrity or performance of the Service
• Transmit any unsolicited communications or spam
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service in any way that could harm, disable, overburden, or impair Datable's servers or networks
• Circumvent any access controls or security features of the Service
• Use the Service to develop a competing product or service

Datable reserves the right to investigate and take appropriate legal action against anyone who, in Datable's sole discretion, violates this provision, including removing offending content, suspending or terminating accounts, and reporting to law enforcement.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DATABLE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR DATA PROVIDED THROUGH THE SERVICE
• WARRANTIES REGARDING THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICE

THIS DISCLAIMER APPLIES TO ALL THIRD-PARTY SERVICE PROVIDERS, INCLUDING OURA AND APPLE, WHOSE SERVICES ARE INTEGRATED WITH DATABLE. DATABLE MAKES NO WARRANTIES ON BEHALF OF ANY THIRD-PARTY SERVICE PROVIDER.

The Bio-Social Health Score™ and all other metrics, insights, and recommendations provided by Datable are for informational and wellness purposes only and do not constitute medical advice. Datable does not warrant the clinical accuracy of any health-related information provided through the Service.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DATABLE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your access to or use of (or inability to access or use) the Service
• Any content or data obtained through the Service
• Unauthorized access to or alteration of your data
• Any third-party conduct or content on the Service
• Any interruption or cessation of the Service

IN NO EVENT SHALL DATABLE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DATABLE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to defend, indemnify, and hold harmless Datable, Inc. and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service
• Your User Content
• Your violation of any third party's rights, including intellectual property rights
• Your violation of any applicable law or regulation

12.1 Termination by Datable

Datable may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.

12.2 Effect of Termination

Upon termination of your account, Datable will delete your personal data in accordance with our Privacy Policy. Sections 7 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), 13 (Governing Law), and any other provisions that by their nature should survive termination, will survive termination of these Terms.

12.3 Third-Party Integration Termination

If your access to a third-party integration (such as Oura) is revoked or terminated, Datable will delete all associated data from that integration in accordance with the applicable third-party API agreement and our Privacy Policy.

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Houston, Texas for the resolution of any disputes.

13.2 Informal Resolution

Before filing any formal legal claim, you agree to first contact Datable at [email protected] and attempt to resolve the dispute informally. We will attempt to resolve any dispute within 30 days.

13.3 Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated, or representative action.

Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described at the time of purchase. All fees are non-refundable except as required by applicable law or as expressly stated in our refund policy.

• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through the app or your device's subscription management settings
• Cancellation takes effect at the end of the current billing period
• Datable reserves the right to change subscription pricing with reasonable notice

Payment processing is handled by third-party payment processors. Datable does not store your full payment card information.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new "Last Updated" date and, for significant changes, by sending an email to your registered address.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Datable regarding the Service and supersede all prior agreements.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Datable's failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
• Assignment: You may not assign your rights under these Terms without Datable's prior written consent. Datable may assign its rights without restriction.
• Force Majeure: Datable will not be liable for any failure or delay in performance due to causes beyond our reasonable control.
• No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
